1. There is a 5% Buyers Premium for on site bidders. For Internet bidders there is an additional 2% internet fee.
2. The Tax rate is : Rolling stock is 3.375%, Titled Items is 3.25%, all other items is 9%.
3. Internet bidders must register using a permanent address(no P.O. boxes accepted) and faxing a bank letter Of guarantee to Black Warrior Auction before you will be registered. All winning internet bidders must have Equipment paid for within 48 hours of auction notification of winning bids.
4. Full payment must be made on sale day by buyer before buyer or equipment can leave premises.
5. Payments accepted are Cash, Certified Funds. Business and Personal Checks accepted if accompanied by a bank Letter of guarantee. If no letter of guarantee is given then purchases will be held until funds clear your bank.
6. All Titled Items will be charged a $30.00 Title Application Fee.
7. The Auctioneer will give notice to winning bidder after each lot is sold. Item becomes full responsibility of the buyer at the time of purchase. Buyer assumes all risk of loss or damage while equipment is own our sale site.
8. If at any time during the auction and there is a tie bid or a dispute forms between bidders, the auctioneer reserves the right to reopen the item for bidding. Then auctioneer will give notice of winning bidder which shall be final.
9. All equipment must have a paid ticket before it will be allowed to leave sale site.
10. There will be no loading of equipment while auction is in progress.
11. All equipment is sold "AS IS, WHERE IS" with no warranty written or implied.
12. This catalog is a guide and a guide only. Black Warrior Auction Co. does not guarantee the information in this catalog to be 100% correct, all information was obtained from sources assumed to be correct, but is not guaranteed by Black Warrior Auction Co.
13. All announcements made on sale day take precedence over any information advertised or distributed information.
14. All attendees and registered bidders acknowledges responsiblity for any personal injury and property damage causee by attendee, by bidder or agent for bidder, and further agrees to hold Auctioneer and Black Warrior Auction Co. harmless for any personal injury and any property damage incurred on sale site.
15. If a successful bidder is a licensed dealer then dealer is to provide Black Warrior Auction Co. a Certificate
Of Resale. This certificate must bear your resale tax permit number. Failure to furnish the correct number will require payment of sales tax on all purchases.
16. Auctioneer at any time and without notice to bidder may withdraw or cancel the sale of any lot and offer any lots in groups or by choice.
17. All registered bidders grants to the auctioneer a security of interest of purchases secure payment of the purchase price. If non-payment occurs the auctioneer may proceed to file the bidder registration agreement as a financing statement to protect the security interest granted by this security agreement.
18. Buyer will not be given possession of any purchases until total puchase price has been paid including any applicable taxes. In the event buyer fails to pay amount due, auctioneer shall retain a lien on all purchases of buyer and at auctioneer's discretion have the right to resale such purchases by public or private sale without notice to buyer. Should auctioneer resale any purchase, the sales price less commission and expenses will be credited to the original buyers account and the original buyer shall upon demand pay auctioneer any deficiency arising from the resale.
19. Overseas bidders will need to wire transfer $10,000.00 dollars to Black Warrior Auction which will apply to purchases if wining bidder, if no bids are successful then money will be wired back within 48 hours of the next available business day.
